The file is a derivative work of Lasinpuhaltaja (Q65238846), a 1960 sculpture by Kalervo Kallio (1909–1969; Q5898122), located in Riihimäki, Finland. The original work (the sculpture) is still under copyright and thus not in public domain until 2040-01-01. Freedom of panorama is for buildings only in Finland. A guide in Finland for photographing public art objects (e.g. sculptures) says, free translation from Finnish: "Photographing a work of art, such as a sculpture, is allowed when the work is permanently placed in or in the immediate vicinity of a public place. A photograph of such a work may not be published as the main subject for gainful purposes and, for example, a postcard must be authorised by the rightholder. "

- Very many wikipedia lists of public sculptures/monuments in Finnish cities have similar photos, and there are other similar photos in the Riihimäki list, too. If this particular photo is removed, there will be a massive task ahead to remove other similar photos of public sculptures that do not have explicit permission from the sculptor.
- I very much wonder about this requirement, as I understand it is not in line with the Finnish guidelines on photography (such as the Finnfoto ry guidelines). And it will change very much the content of wiki commons. PenHei (talk) 06:26, 17 August 2024 (UTC)

This photo is extracted from a conference paper presented at the 26th Conference on Severe Local Storms held by the American Meteorological Society, Poster Session P7, 3:00 PM-4:15 PM: Wednesday, 7 November 2012, Loews Vanderbilt Hotel, Nashville. The paper is downloadable in PDF format here. The photo is on page 2 and was taken near near Calumet, Oklahoma, shortly after May 24, 2011.
The conference paper was co-authored by four people, three of whom were employees of the NWS, and one an employee of a private enterprise, Haag Engineering Co., Irving, Texas. The paper doesn't identify the source of the photo; whether it was one of the four authors or someone else entirely.
The uploader has tagged it with {{PD-NWS}}, claiming that it is in the public domain because:
- it was "stored on the web servers of the U.S. National Weather Service" and
- the NWS Sioux Falls regional office once hosted a photo competition where a condition of entry was that any submitted photo "is being released into the public domain"
However, putting aside any scrutiny of these two rationales in this instance: because we don't know who actually took it, we have no evidence that this photo was taken by a federal government employee in the course of their duties (which would have made it ineligible for copyight in the first place) or that, if copyright ever did exist over this image, we have no evidence of permission that it was ever transferred into the public domain.
Works created in the US since 1989 do not need to be published with a copyright notice or to have their copyright registered in order to be protected. The conference paper was published in 2011.
The source, as given by the uploader, is not hosted on an NWS web server, nor is there any evidence that it ever was.
Nor is there any evidence to suggest that it was ever entered into a photo competition at NWS Sioux Falls.

However, I cannot confidently say “delete” as an article by an IWeatherNet meteorologist claims the photograph is in the public domain, giving possible indications for a CC-zero template. - Comment: Yeah, could be. One of the challenges I'm seeing when trying to track some of these down when the primary links are dead is that a lot of sources are relying on Wikipedia or Commons as their sources, meaning that if we've got the analysis wrong, we've given them bad advice. The scariest one I've seen is one of the images still in my "too hard basket" but which I've found used on an album cover...! - This is a previous logo of Strise AS. During its usage, a large company approached us claiming that our logo bore a striking resemblance to theirs. They threatened us with a lawsuit if we didn't modify our logo. Although their case may or may not have been strong, as a small company, we lack the resources to defend ourselves in a legal battle. - You are right on two points: 1. The photographer must care. 2. This is not a copyright issue. – The rest of your statement is misguided. The situation is not comparable to taking a picture in a museum. It is not about a relation between two parties only. It is about a possible breach of law. French legislation applies, and the article 226-4 of the French Penal Code penalizes the breaking into a private property. A good that has been acquired unlawfully may not be used. This, of course, also applies to third parties: we (!) may not use a picture that was taken during a break-in.
- The question is now: did such break-in take place? Following some correspondence with both the landlady and with a lawyer friend who is familiar with French law it is now clear that it hasn't. The key point is that the premises must be enclosed: by a fence, a wall, or at least by a sign prohibiting unauthorized access. Only under such conditions does French law consider it to be a break-in. The owner was so honest as to admit in her last letter to the support team that such a barrier did not exist when the photo was taken.
- We can thus keep the image. Deletion by courtesy might be an option, since it was the photographer himself who started the request.

No, I did not know it was what our nominator, TheImaCow, called a "careless copy". But, subsequent to my upload, User:Hohum uploaded a color corrected version.
The NARA version(s) our nominator says he or she prefers ARE NOT color corrected.
I am going to ask, doesn't this means our nominator should withdraw this nomination, and make individual nominations?

- Keep I clicked to a couple of files and some of them are (carelessly?) in use. Just deleting them would remove them from the articles. I don't think a mass deletion request is the right approach. - Plenty of files had already been tagged as {{Duplicate}}, but those have been declined by @Mdaniels5757. Random examples here here here here here here I don't think its appropiate to simply re-add this.
- Re tagging using duplicate template; people spending ten minutes copying those files en masse could not be bothered to check if they existed already. Now I don't see why others should have to spend hours cleaning this up by cross-referencing the original file on hundreds of automatically created duplicates.
- I don't have anything againest going through and replacing them where in use, or copying better categorisation over to original, but using {{Duplicate}} on every file is not worth the time & effort. ~TheImaCow (talk) 19:22, 16 August 2024 (UTC)
- Comment: Now I have spend OVER TWO HOURS and lost countless braincells while individually going through all +700 files and copying categorisation if better, replacing existing usages etc. I also removed a handful of files from the above list, where some geniuses have deleted the uncompressed, better described & older original files as duplicates instead of the flickr copies.

You are asking for a speedy deletion for many photos at once, without supplying the alleged "duplicate' photo for each photo subject to your deletion request. You make reference to only one file as an "example" as a substitute for each and every other file proposed for deletion. You wrote:
