Copyrighted work of art, photographed in the United States (no FOP). This work is not in the public domain as claimed in the description, the copyright for this work is still active and is owned by the Robert Smithson Foundation: https://holtsmithsonfoundation.org/spiral-jetty 19h00s (talk) 21:04, 25 November 2022 (UTC)
- (in bad english, you can improve it) I don't understand. I didn't find this picture on the site https://holtsmithsonfoundation.org/spiral-jetty. The author of Spiral Jetty is en:Robert Smithson. I don't know the american law about art work in public space but, either it is forbidden to take and publish such picture (in this case alle the picture of category:Spiral Jetty must be deleted), or it is allowed (then there is no reason to delete this one).

- Spiral Jetty is a copyrighted work of land art - the work of art itself is under copyright (not the photograph). You are correct, all images in that category should be deleted. On the website they list the copyright ownership for the work of art itself. 19h00s (talk) 14:44, 26 November 2022 (UTC)
- (In the United States, there is no freedom of panorama to publish photographs of copyrighted art in public spaces. You can take picture of copyrighted art, but you must get permission from the copyright owner to formally publish those images - uploading an image to Wikimedia counts as publishing) 19h00s (talk) 14:46, 26 November 2022 (UTC)
19h00s (talk) 14:57, 26 November 2022 (UTC)
- Keep - The file page correctly explains that this work is public domain as it was published (i.e. made available to the public) prior to 1978 without a copyright notice. FOP is irrelevant in this case. Nosferattus (talk) 00:40, 27 November 2022 (UTC)
- Keep. Per Nosferattus. A clearly spurious copyright claim. This was exhibited publicly in 1970, putting this in the public domain per {{PD-US-no notice}} (see Commons:Public art and copyrights in the US). IronGargoyle (talk) 12:02, 2 December 2022 (UTC)
- Keep per lack of copyright notice and not meeting the threshold of originality. Rocks arranged in a simple spiral shape don't contain enough originality to be copyrightable in the U.S. And any originality that might have been found in the fine-grained details of how the rocks were arranged has eroded away in the more than 30 years between when the work was created and when the photo was taken, as the rocks have been shifted by the forces of nature. - 'Keep per my comments here. TE(æ)A,ea. (talk) 04:11, 6 December 2022 (UTC)
- Keep while I consider U.S. TOO on artistic structures as too low (architecture, sculptures et cetera, in contrast to high TOO for logos), this artwork was installed during the era of 1927–1977 when registration was required, and unless there is a physical proof of a copyright notice this is a public domain work: {{PD-US-no notice}}. Kept: per discussion. —Mdaniels5757 (talk • contribs) 16:16, 26 March 2023 (UTC)
