There isn't any examples or evidence as to how this isn't the uploader's own work, in the deletion rational states a quote without any evidence (I see nothing in the upload that states the above) and the file is in scope of the project (as it is in use). The uploader doesn't have to upload the negative nor the back of the photograph, there is no doubt in this case that warrants it and even then we would only ask them to send it to COM:OTRS and you would be setting a precedent for anyone uploading scanned (own work) photographs. Without further information about the source of this file, it's not "safe to say this is in the public domain." It's possible that it was published prior to 1923, but that would need to be shown by the source of the image, but the website sourced gives no sources or dates for their pictures. Their page is, however, clearly marked "© 2014 AMA Motorcycle Hall of Fame, All Rights Reserved " I put this to the community for help and consensus.   • On my talk page, Asclepias (talk · contribs) claims that the company which operated the ship was based on Gothenburg. Swedish ownership is also indicated by the coat of arms and flag on the ship. The dates are consistent with the dates in {{PD-Italy}} and {{PD-Sweden-photo}}, but the source country is the country of first publication, and this country seems to be unidentified. As the source country is unidentified, we can't say anything about the copyright status in that country, although the photograph should be in the public domain in both Italy and Sweden. Unclear in-scope usage, at least four of which appear to be very similar images of a customer area of a shop and not clearly in-scope. If there's a case to keep these (particularly the first two) then I'm willing to hear it, but it should be clearer. I think that is the inverse. The site "Viajar pelo mundo" is using commons photos and from other sites on their page, without the proper attribution. See: File:Praça da Ribeira (7879661550).jpg and File:Graham Tawny Vino de Oporto.jpg. Maybe we could inform the authors of these photos on Flickr to see what they have to say about? — Also, the album of flickr user bittencourtRUI ([6]) has 75 photos of Portugal, mostly about Porto, and it doesn't look to me that he went to grab all these photos from other sites to do his album. Maybe we could compare the dates of the photos against the date of "Viajar pelo mundo" publication to see witch was the first? Certainly not PD-self. As Einstein died in 1955, I doubt these are in the public in the country of origin (Germany). For Category:US National Archives series: Albert Einstein's Letters, compiled 05/17/1943 - 10/14/1944, it is not so clear what is the copyright status, but there are not works of the US government anyway. Could they be considered published without a notice?

As a rule the Copyright Office will not register a copyright in a costume, even one that is fanciful and not ordinary wear, on the grounds that because it covers and protects the body it is useful. On the other hand, the Copyright Office has clearly stated that masks that exceed the ToO do have a copyright. This is set forth clearly in its 1991 policy decision on costumes and masks.

AnonMoos, you have said several times that it is a robot, as if robots somehow do not have a copyright. First, it is not a robot, as it is manually operated -- it is a radio controlled puppet or muppet. Second, even if it were a robot, it still has a skull as its head. There is no reason at all why a sculpture of a skull cannot have a copyright. All sculpture above the ToO has a copyright and this is certainly above the ToO. Sure. A faithful replica of a human head, or a lion, or whatever, has a copyright. Dolls have copyrights. Store mannequins have copyrights.
I suppose that if an artisan took a real skull, cast a mold around it using latex or one of the other flexible molding compounds, and then cast a replica inside the mold, that you might argue that there was no creativity. However, taxidermy (stuffed animals) has a copyright in the US, so I think that even the molded copy would probably have one. I don't need it at all. But it was for years the Wikipedia image (only de on one page in this case, but still.) I've no idea who uses this version (outside of Wikimedia, where nobody uses it anymore.) These re-users (some found by Google for a similar case, here I was too lazy to check it again, because the absence of evidence is anyway no evidence of absence) trust that commons does not hide the important license etc. for their attribution links or similar references.  Delete COM:D does not bless inertia as a reason to keep. Instead, it explicitly note that "Files that add nothing educationally distinct to the collection of images we already hold covering the same subject, especially if they are of poor or mediocre quality" fall below the "realistically useful for an educational purpose" threshold and therefore fails to be within Commons:Project scope. Newer, higher-quality images displace (and seem to lead to deletion of) older ones all the time. The nom'ed image is jaggy and not very large, whereas the proposed replacement solves those quality problems--this is not an argument based on file format, but on the quality of the superceded image itself. Various of the current standards fort chemical drawing do bless high quality PNG in addition to SVG. This image is not just released by the creator as PD, but is intrinsically PD by its very nature, so there is no legal basis for needing to trace the license back from an external reuser to verify that the reuser isn't lying about it being freely released. As presently described, this image has no source but is being claimed for copyright by Alan Jones who uploaded the image. I found this image in multiple places on the web including http://www.masonic-lodge-of-education.com/images/Shriners002Black_small_300x256.jpg. It may be old enough to be kept, but as the file is currently described, sourced and licensed, it is not correct and needs to be fixed before "kept" if that is the consensus of the community. This file was initially tagged by Bilby as Copyvio (copyvio) and the most recent rationale was: The video is an interview from ABC's morning show, which is copyrighted to the ABC.
